AGREEMENT
In the following terms and conditions “The Photographer” (“Chris Burns”, ”Chris Burns Photography”) refers to Chris Burns trading as Chris Burns Photography. “Client” or “you” shall be those persons named in the invoice. The following Terms and Conditions may be varied at any time, with or without notice to you, at the photographers sole discretion.
The client agrees to engage Chris Burns as the photographer to provide a photographic service and deliver digital photographs via an online gallery.
DEPOSIT PAYMENT
A 50% deposit is required upon booking to secure your preferred date and price. Your date and price is not deemed secured until the deposit has been made. By making the deposit payment the client is in agreeance with the terms and conditions herein and is entering into a contract with the Photographer.
CANCELLATIONS OR RESCHEDULING
In the event of an exceptional circumstance whereby a shoot can not proceed. The client may reschedule using their initial deposit. Should the shoot need to be cancelled indefinitely the photographer reserves the right to retain 30% of the total invoice regardless of how much work has been carried out prior to the cancellation. In the event that Chris Burns Photography is unable to fulfil its services as specified in the agreed invoice due to; illness, serious injury, elements of nature (including fire, flood, storm or other casualty), faulty equipment, government regulation or restrictions, Chris Burns Photography’s liability shall be limited to either the return of any monies paid in agreed invoice or the arrangement of an alternate shoot date.
product use (if applicable)
Applicable only if products or props are being returned. Although utmost care will be taken to maintain the “near new” condition of the product/props being shot, the client acknowledges that in some instances at the discretion of the Photographer it may be required to unpackage, open, wear or use the product in order to demonstrate its desired use. If the client does not wish for this to occur please inform the Photographer prior to the intended shoot date.
TRAVEL & location
On location refers to the photographer travelling to your store, business address or a hired shoot location. However, travel beyond a 30km radius of Bacchus Marsh, Victoria to locations requested at the time of booking may incur a travel fee. This will be established on a case by case basis. All travel fees will be agreed upon in writing (if applicable) in the client invoice. Half days in the field and/or on location are equivalent to 4 hours total not including travel. Full days in the field and/or on location are equivalent to 8 hours total not including travel. The client understands that the total package hours may not occur concurrently. It is possible they will be spread across differing times or days to capture the perfect light of day. (For example dawn & dusk)
Shoots may be conducted in the field or in the studio sometimes a mix of both. This will be at the discretion of the photographer based on their expertise, artistic judgement and vision for the shoot. If hire of a shoot location is required all relevant fees and arrangements are the responsibility of the client, unless otherwise agreed in writing with The Photographer.
EDITING
In entering this contract you understand that your product will be styled and shot in a way that is true to Chris Burns photography but in line with your brand aesthetic.
The photographer is dedicated to capturing and providing natural and photojournalistic style images. Our prices do not include advanced editing which includes removal of objects in the backgrounds or distracting elements. Additional editing may be requested and a fee per image will be quoted upon request and must be accepted prior to any work being carried out.
usage definitions
“Publicity” use is when the client submits photographs to an outside publication (whether print or electronic) for editorial use and the client (or their client) is not paying for that use. “Advertising” use is when the client (or their client) is paying for the placement of a photograph in whatever media it appears, such as in a newspaper, magazine, billboard or website. “Internal Collateral” use is when the photographs appear in a publication that the client produces, such as a magazine, brochure, flyer, poster or website, and whose audience is limited to the client’s employees. “External Collateral” use is when the photographs appear in a publication the client produces, such as an annual report, magazine, EDM, brochure or website, and whose audience is customers, shareholders, or the general public.
“Social Media Platform” use refers to platforms including Instagram, Facebook, Twitter, LinkedIn, PINTEREST.
IMAGE use
The client is able to use purchased imagery for publicity, social media platform, internal collateral and advertising usage with the exception of Billboards*. Licence does not extend beyond usage as stated above. Should the images be given to and/or utilised by any other business, brand or person besides the licencee stated in the invoice a fee of $250 per image shall be paid to The Photographer.
billboard image use
Should the client wish to licence imagery for billboard usage a prorata fee of $7,500 per image for 12 months in 1 location shall be paid to The Photographer.
IMAGE DELIVERY & Storage
Clients will be supplied with high resolution j-peg files delivered via an online password-protected gallery. Depending on the size of the project, the images will be uploaded no later than 20 business days following the confirmed shoot date. Images will be available for download for 30 days after which time they will be removed from the platform.
SOCIAL MEDIA & ADVERTISING
The Photographer often shares content from photoshoots for advertising and/or promotional uses on their numerous business platforms. Including but not limited to their Instagram account, business collateral and website. If you would prefer these images not to be shared as stated above, please let the Photographer know in advance of your photoshoot.
talent
If not specified on the package inclusions and the client wishes for the photographer to source and supply talent for the photographic shoot a fee of $250 per day per person will be applicable.
overtime
If in the event that the photo shoot goes overtime. An additional fee of $750 per hour will be charged and payable by the client.
ACCIDENT, INJURY, oh&s
The Photographer or Studio may not be held liable for any mishap or malfunction including damage to property or goods, or injury to persons while on location.
